Athens judge orders new election in NE Ga House race

There will be a do-over election in House District 28: a judge has ordered a new primary between State Rep Dan Gasaway and former Banks County School Superintendent Chris Erwin. Erwin defeated Gasaway in the May 22 Republican primary by a 67-vote margin, but Judge David Sweat agreed with Gasaway’s claims that some voters in the district that includes parts of Banks, Stephens, and Habersham counties were given the wrong ballots.

“It is the Court’s view that the results of the primary election must be set aside and a new election held,” Judge Sweat said in announcing his ruling. “The Court’s view is that it’s going to be necessary to conduct a new election.”

Another hearing will be held today to figure out when and how to hold the new election.
