Athens Judge sets date for NE Ga House election

April 9 is now set as the date for a third election to fill the House District 28 seat in the Georgia legislature. Athens Judge David Sweat has also ordered the winner of two elections last year to vacate the seat while the legislature is still in session. Former Banks County School Superintendent Chris Erwin defeated incumbent Dan Gasaway by 67 votes in a Republican primary last May; those elections results were tossed because a mapping mistake sent some voters to the wrong precincts.

Erwin won a special election in December by just two votes, but Judge Sweat then ruled that at least four votes were improperly cast in that election.
